IRS Expands Info Describing Health IT Donations

The IRS released additional guidance (pdf) to clarify the new regulations approved in May which allow individual practitioners to receive gifts in the form of health information technology, particularly electronic records systems from hospital facilities. The donations were approved as an exception to anti-kickback laws.

The regulations describe efforts by hospitals to provide staff physicians with electronic health records software. In order to be compliant with IRS mandates, hospitals and physicians must continually meet the requirements described by the HHS EHR Regulations.
